Binding Document Regarding Final Purchases and Refunds
This Binding Document (“Document”) outlines the terms and conditions governing purchases made through WARRIORS of CRPS Nonprofit Foundation (“we,” “us,” or “our”) in relation to artwork created by artists. By making a purchase through our platform, you agree to be bound by the terms set forth in this Document.
1. Finality of Purchases:
- Due to the unique and often personalized nature of artwork created by artists, all purchases made through our platform are final. Once a purchase is completed and payment is received, it cannot be canceled, refunded, or exchanged, except as otherwise provided in this Document.
- It is important to carefully review the artwork details, descriptions, and any accompanying information before making a purchase. If you have any questions or require additional information, please contact us prior to completing your purchase.
2. Proof of Tracking Number:
- In the event that an artist fails to provide proof of a valid tracking number for the shipment of the artwork to the buyer, we reserve the right to refund the purchase amount to the buyer.
- The artist is responsible for providing the tracking number within a reasonable timeframe after the purchase is completed. Failure to do so may result in a refund to the buyer.
3. Insurance on Packages:
- We strongly recommend that artists purchase insurance for the shipment of their artwork to protect against loss, damage, or theft during transit.
- While insurance is not mandatory, it is the responsibility of the artist to ensure the safe and secure delivery of the artwork to the buyer. We are not liable for any loss, damage, or theft that may occur during shipment.
4. Limitation of Liability:
- To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with a purchase made through our platform.
- We shall not be responsible for any issues, disputes, or disagreements that may arise between the buyer and the artist, including but not limited to issues related to the quality, condition, authenticity, or delivery of the artwork.
5. Governing Law and Jurisdiction:
This Document shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any legal action or proceeding arising out of or related to this Document shall be brought exclusively in the courts of [Jurisdiction], and you consent to the personal jurisdiction of such courts.
6. Severability:
If any provision of this Document is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
