Binding Notice Regarding Donations
This Binding Notice (“Notice”) outlines the terms and conditions governing donations made to WARRIORS of CRPS Nonprofit Foundation (“we,” “us,” or “our”) through our website. By making a donation, you agree to be bound by the terms set forth in this Notice.
1. Donations Are Final:
a. All donations made to WARRIORS of CRPS Nonprofit Foundation are considered final and non-refundable. Once a donation is made and payment is processed, it cannot be canceled, refunded, or reversed, except as otherwise provided by applicable law.
b. We encourage donors to carefully review the donation amount and ensure the accuracy of the donation before submitting the payment.
2. Bounced Checks and Recovery Fee:
a. In the event that a donated check is returned unpaid or a donation made via electronic payment is reversed or charged back, we reserve the right to assess a recovery fee of twenty-five dollars ($25) to cover administrative and banking costs.
b. The recovery fee will be deducted from the original donated amount, and the remaining balance will be considered a valid donation to WARRIORS of CRPS Nonprofit Foundation.
3. Monthly Donations:
a. If you choose to make a monthly donation, it will be billed automatically on a recurring basis until a written or verbal request to cancel is received.
b. To cancel a monthly donation, you may contact us by phone at 747-388-1748 or by email at sddept@warriorsofcrps.org. We require a reasonable amount of time to process cancellation requests, and you may be billed for one final monthly donation before the cancellation takes effect.
4. Modification or Termination of Donations:
a. We reserve the right to modify or terminate the acceptance of donations at any time, for any reason, and without prior notice.
b. In the event that we terminate the acceptance of donations, any recurring monthly donations will be canceled automatically.
5. Governing Law and Jurisdiction:
This Notice shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any legal action or proceeding arising out of or related to this Notice shall be brought exclusively in the courts of Los Angeles County, California and you consent to the personal jurisdiction of such courts.
6. Severability:
If any provision of this Notice is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
